Acceptance of Terms

These terms cover any and all prodcuts or services provided by Blue Violet Publishing, LLC, and/or its DBAs (doing business as names) of Abigail Owen (author/pen name), Kadie Scott (author/pen name), Kristen McKanagh (author/pen name), Abbie Wilde (author/pen name), and Authors On A Dime(author services provider), (hereafter “we,” “us,” or “our”). Your request of our services is subject to your compliance with the terms and conditions set forth in this Terms & Conditions agreement (“Terms & Conditions,” “Terms of Use”), which supplement any additional guidelines or other terms posted by us in relation to specific services or content or materials. We reserve the right to update or modify the Terms of Use without advance notice by posting a revised Terms of Use to this Web Site. By using the Web Site, you agree to be bound by the version of the Terms of Use then in effect. We advise you to print and retain a copy of this Terms of Use in hard copy as a record.

Disclaimers

Abigail Owen, Kadie Scott, Kristen McKanagh, and Abbie Wilde write ADULT books, written for and enjoyed by adults. Some books may be marketed by publishers as Young Adult (YA) or New Adult (NA). Abigail Owen’s YA and NA books are for upper YA. These are intended for persons 18+ and may include mature or sexual content. Abbie Wilde writes erotica intended for mature audiences only. Parents of under 18 persons, it is your responsibility to review the books your children read and give your permission to read those books.

Works by Abigail Owen, Kadie Scott, Kristen McKanagh, and Abbie Wilde may includes elements that might not be suitable for all readers, including but not limited to: violence, gore, death, fantastical elements, mature themes or images, poverty, and sexual content. It is the reader’s responsibility to know their own triggers and limits, and choose what to read at their discretion. For all Author Pen Names under Blue Violet Publishing, LLC (Abigail Owen, Kadie Scott, Kristen McKanagh, and Abbie Wilde), written and designed products provided are the result of our personal creation, work, experience, opinion, and preference. We do not guarantee results or satisfaction.

Authors On A Dime is not a publishing firm or a marketing firm. For all services and products provided, we do not guarantee results including, but not limited to, the following: sales, book rankings, contracts with literary agents or publishers, good reviews, any reviews, likes, shares, follows, and click thrus.

Liability

Blue Violet Publishing, LLC can’t guarantee work will be error-free and are not liable to the Client or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages.

Copyright for Author Works or Graphic Designs

For all works written, designed, and/or published, by Blue Violet Publishing, LLC authors using pen names Abigail Owen, Kadie Scott, Kristen McKanagh, and/or Abbie Wilde, copyright applies.

For all graphic works designed by Blue Violet Publishing, LLC for its authors using pen names Abigail Owen, Kadie Scott, Kristen McKanagh, and/or Abbie Wilde, copyright applies.

ALL RIGHTS RESERVED.

We may use stock images from Deposit Photos, Adobe Stock Images, or other similar services for which we will obtain all licenses and rights.

We may use custom fonts from DaFont.com or Fonts.com or other similar services for which we will obtain all licenses and rights, including eBook and print book rights.

For all graphics designed and provided by 3rd parties including but not limited to contracted publishers, PR firms, for the purposes of marketing the authors listed above works or marketing author-related events and occurences, the 3rd party owns the copyright.

You may not alter, change, reuse, or repurpose copyrighted words, images, or elements for purposes other than the original intent of the work. (Ex. A book cover may be used for any purpose involving publishing and marketing that book, but not for any other use.).

Copyright for Authors On A Dime Products

When the Authors On A Dime Client’s final payment has cleared, copyright will be automatically assigned as follows:

Authors On A Dime may use stock images from Deposit Photos, Adobe Stock Images, or other similar services for which we will obtain all licenses and rights.

Authors On A Dime may use custom fonts from DaFont.com or Fonts.com or other similar services for which we will obtain all licenses and rights, including eBook rights.

Any custom image or content provided by Authors On A Dime, as a service or product to our clients is protected under Copyright law. Authors On A Dime owns the unique combination of visual elements that constitutes a complete design and will license that the Client, exclusively and in perpetuity for that project only, unless we agree otherwise. You may not alter, change, reuse, or repurpose the images or elements for purposes other than the original intent of the image. (Ex. A book cover may be used for any purpose involving publishing and marketing that book, but not for any other use.).

Authors On A Dime will not use any of the primary images of your final product on other graphics designed by our company.

The service/product fee does not include the rights to any of the draft products provided. Any designs/images NOT selected from the initial designs provided are owned by Authors On A Dime and are subject to being sold/used for other projects.

Authors On A Dime will provide the source files and finished files and the Client should keep them somewhere safe as Authors On A Dime is not required to keep a copy.

All custom images or content should be credited as such: Content Type (ex. Cover Design) by Authors On A Dime.

Pricing for Author Goods

For the authors listed above, pricing for all books, products, and merchandise offered on the websites listed above, at online retailers (such as Amazon and Barnes and Noble) that are not piracy sites, at brick and mortar stores, or via online shops (such as Shopify, Etsy, Patreon) is listed on the site or product. Blue Violet Publishing, LLC, does not control pricing for any products contracted to traditional publishers or subsidiaries. All prices are subject to change. Check price before purchase.

Pricing for Authors On A Dime Goods & Services

Prices for Authors On A Dime products and services are posted on the website (authorsonadime.com), but are subject to negotiation. We reserve the right to adjust pricing based on workload or rush orders or other circumstances we deem appropriate. We will inform you before starting a project of the price. If a project requires additional unforseen work, or the Client would like to change the scope, all work will be stopped until a new negotiated price can be determined. Accepting the service means you are accepting the agreed upon price.

Accepting the service also means you will pay 100% within 30 days of receiving the invoice.

The total agreed upon amount to be paid via PayPal upon receipt of the PayPal invoice email.

*All Authors On A Dime services/products are subject to service fee (3% USD payments, 7.5% for foreign currency transactions).

Scope of Work for Authors On A Dime

Each service or product offered by Authors On A Dime requires specific hours and method to complete the project. Read the description of your service or product to fully understand what is included in the fee/price. Those descriptions are part of your understood contract by accepting these terms and conditions.

Fee Schedule for Authors On A Dime

For service packages above $200, Authors On A Dime may bill for 50% before starting work and 50% after completion. For services/packages $199 and under, Authors On A Dime may bill 100% of the project after completion.

The total agreed upon amount to be paid via PayPal upon receipt of the PayPal invoice email.

*All Authors On A Dime services/products are subject to service fee (3% USD payments, 7.5% for foreign currency transactions).

Period of Performance for Authors On A Dime

For services/products purchased from Authors On A Dime, you may request a delivery date, and we will inform you before starting a project if that date is acceptable. If not, we will provide an alternative date based on our workload. Accepting the service means you are accepting the agreed upon delivery date. Authors On A Dime will endeavor to meet all the deadlines set, but won’t be responsible for a missed launch date or a deadline if the Client has been late in supplying materials or have not approved or signed off work on-time at any stage.

Authors On A Dime Client Responsibilities

The Authors On A Dime Client will provide requirements for the project including but not limited to: information, images, feedback, completed forms, etc.

The Client will provide timely feedback, responses to questions, or materials as needed.

The Client will approve and proofread the final product. The client’s approval of all tangible materials,  artwork, editing, etc. will be assumed after the work has been submitted for review, unless the Client indicates otherwise in writing.

The Client guarantees all elements of text, graphics, photos, designs, trademarks, or other artwork provided are either owned by the Client, or the Client has permission to use them.

Payment to Authors On A Dime

Accepting the service also means you agree to pay 100% of the agreed price/all outstanding invoices related to that project within 30 days of receiving the final invoice.

The total agreed upon amount to be paid via PayPal upon receipt of the PayPal invoice email.

Privacy Policy

Blue Violet Publishing, LLC, is committed to your right to privacy and to keeping your personal information private. We have developed our Privacy Policy to inform you of our policies and practices regarding information we collect about you.

Refusal of Service

We reserve the right to refuse service. We may refuse service to you at any time and in its sole discretion, including, in the event you do not adhere to the Terms of Use.  We may refuse service for any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. In addition, we may refuse service if we determine our current workload prevents us from taking on new business at any given time.

Refund & Replacement Policy

Blue Violet Publishing, LLC offers the following refund and replacement policy. You acknowledge that we are NOT required to provide refunds or replacements for any products purchased or services rendered by any of our DBAs.

All products or services purchased through 3rd party retailers (online or brick and mortar stores), please see their Terms & Conditions and contact them for refunds/replacements.

All Authors On A Dime payments received are not refundable in the event the project or the relationship is terminated for any reason. If any part of the work for this project is delayed for longer than 30 days, we will bill for work completed.

Authors On A Dime will replace damaged products purchased with either an undamaged file of the work, or a work or equal value. You must request replacement of damaged files within Seventy-two (72) hours of purchase. If you do not request a refund within the period specified, you forfeit this option and will not be eligible for a refund.

We reserve the right to suspend work and/or withhold issuing any project documents if invoice payments are not received within a reasonable period of time from invoice date or contracted payment period.

We do NOT offer refunds on any services or products that you may purchase directly through Blue Violet Publishing, LLC via our Shopify store.

Warranties

Our sites and the materials and products on our sites or provided by Blue Violet Publishing, LLC, and/or its DBAs, are provided “as is” and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, Blue Violet Publishing, LLC, and/or its DBAs, disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. Blue Violet Publishing, LLC, and/or its DBAs, does not represent or warrant that the functions contained in the site, or in products and services provided, will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Blue Violet Publishing, LLC, and/or its DBAs, does not make any warranties or representations regarding the use of the materials in this site, products or services provided, in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

NO ORAL OR WRITTEN INFORMATION, ADVICE OR ADVERTISEMENT GIVEN BY BLUE VIOLET PUBLISHING, LLC, ITS DBAS, CONTRACTORS, SUPPLIERS, DISTRIBUTORS, AGENTS, EMPLOYEES, OR REPRESENTATIVES WILL CREATE A WARRANTY, AND YOU AGREE NOT TO RELY ON ANY SUCH INFORMATION OR ADVERTISEMENT FOR SUCH PURPOSES. THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, TITLE AND FITNESS FOR A PARTICULAR PURPOSE ARE SPECIFICALLY DISCLAIMED. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SITE MATERIALS, SERVICES, MERCHANDISE, OR PRODUCTS PROVIDED IS WITH END USER. END USER ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME STATES MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY. Limitation of Liability

IN NO EVENT WILL BLUE VIOLET PUBLISHING, LLC, AND/OR OUR DBAS, OR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THE SITES MATERIALS, PRODUCTS, MERCHANDISE, OR SERVICES PROVIDED BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS, SAVINGS, DAMAGE TO HARDWARE OR LOST OR DAMAGED DATA OR OTHER PROGRAMS ARISING OUT OF THE USE OR INABILITY TO USE THE SITE MATERIALS OR ASSOCIATED INFORMATION (IF ANY), EVEN IF BLUE VIOLET PUBLISHING, LLC, HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATIONS OF LIABILITY SHALL APPLY NOTWITHSTANDING ANY FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY OR ANY CLAIM BY ANY OTHER PARTY. BLUE VIOLET PUBLISHING,LLC’S SOLE LIABILITY TO YOU OR ANY THIRD PARTY, AND YOUR SOLE REMEDY ARISING OUT OF OR RELATED TO THIS AGREEMENT, THE USE OF OR INABILITY TO USE THE SITES MATERIALS OR THE INFORMATION PROVIDED HEREWITH, OR DECISION MADE OR ACTION TAKEN IN RELIANCE UPON SUCH INFORMATION, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE WILL NOT EXCEED IN THE AGGREGATE THE FEE PAID BY YOU FOR THE PRODUCTS OR SERVICES, IF ANY. SOME STATES MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO ALL OR A PORTION OF THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY.

THE ABOVE DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INACCURACY, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF THIS SITE, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR (INCLUDING STRICT LIABILITY), NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. YOU SPECIFICALLY ACKNOWLEDGE THAT AUTHORS ON A DIME, LLC IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS, CLIENTS, CUSTOMERS, OR THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

NO ORAL OR WRITTEN INFORMATION, ADVICE OR ADVERTISEMENT GIVEN BY BLUE VIOLET PUBLISHING, LLC, ITS DBAS, CONTRACTORS, SUPPLIERS, DISTRIBUTORS, AGENTS, EMPLOYEES, OR REPRESENTATIVES WILL CREATE A WARRANTY, AND YOU AGREE NOT TO RELY ON ANY SUCH INFORMATION OR ADVERTISEMENT FOR SUCH PURPOSES. THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, TITLE AND FITNESS FOR A PARTICULAR PURPOSE ARE SPECIFICALLY DISCLAIMED. General Use

Harassment in any manner or form Blue Violet Publishing, LLC or other licensed employee, host, or representative, online via but not limited to website, e-mail, chat, comments, associated emails; in person; or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Blue Violet Publishing, LLC or other licensed employee, host, or representative, is prohibited. You may not upload to, distribute, or otherwise publish any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.

Indemnification

You agree to defend, indemnify and hold harmless Blue Violet Publishing, LLC and our authors, managers, directors, officers, agents, employees, contractors, and consultants, from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees) and other expenses that arise out of or from (a) your activities in connection with our services and products; and (b) any violation of these Terms of Use by you, including breach of any representations or warranties made by you in this Terms and Conditions.

Term; Termination

These terms and conditions are applicable to you upon purchase of any service or product of Blue Violet Publishing, LLC, or its DBAs. We reserve the right to terminate this Agreement at any time without notice for any reason, including, in the case of the Agreement, for your violation of any of its provisions. The Disclaimer and Limitation of Liability and Governing Law sections of this User Agreement shall survive any such termination.

Notice

Blue Violet Publishing, LLC may deliver notice to you by means of e-mail you provided to us, a general notice on any/all of the websites listed above.

Miscellaneous

Your use of any of the sites listed above, or Blue Violet Publishing products or services, shall be governed in all respects by the laws of the state of Texas, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to our sites (including but not limited to the purchase of Blue Violet Publishing, LLC, or its DBAs, products or services) shall be in the state or federal courts located in Williamson County, Texas. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Blue Violet Publishing, LLC, or its DBAs, products or services) must be commenced within one (1) year after the claim or cause of action arises. Blue Violet Publishing, LLC’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Blue Violet Publishing, LLC, and its DBAs may assign its rights and duties under this Agreement to any party at any time without notice to you.
